Technological development and advancements are moving fast, while leaders and regulatory bodies are entangled in this activity. Two examples of the push and pull between AI tool capabilities and the regulations directing product design was illustrated through a dance this week.
Meta’s CEO released a reflection made up of thousands of words weighing the importance of the moment, predicting future technological capabilities, and solutions for how to oversee AI development and deployment. This was the same day Meta released a new AI product. The document also included an announcement that Meta is building personal superintelligence to be widely distributed where individuals could meet their full potential. The document offers many policy proposals, including close coordination between the government and the industry and creating a governance board made up of technology executives.
New public policies are coming online. This month, new AI related transparency requirements became enforceable in California and the European Union (EU). At the same time, Anthropic unveiled that AI generated content created from their tools will now have machine-readable marks in order to meet legal obligations. Watermarks will be embedded in text and a digital trail of who created it, when it was made, and how, among other details.
California’s AI Transparency Act (SB 942/AB 853) went into effect at the beginning of the month. The new law requires that generative AI content like audio, video, and images created by widely-used AI tools include information that it was AI generated and a detailed trail regarding the history of the content.
A piece of the EU AI Act became enforceable at the beginning of August. One of four new transparency requirements is to mark AI-generated synthetic content.
State Policy Action
CA: Many pieces of AI focused legislation are moving through the California State Legislature. Two new proposals made it over the finish line earlier this month and are now awaiting the Governor’s signature. One proposal (AB 1651) requires disclosure of AI generated content that is used in the development or administration of the state’s attorney licensing test.
The other proposal (SB 928) specifies that California State University employees must be human, not AI.
CO: The Department of Law started the official rulemaking process on two new AI laws that are scheduled to go into effect in January. The first (HB 1263) is targeted toward automated decision making technologies during “consequential decisions” and the second (SB 189) focuses on AI chatbots.
NY: A first-in-the-nation law passed in 2025 came into effect this summer that requires advertisers to disclose AI use in ads that run in New York.
After a lengthy process, the Attorney General and Governor released final rules to implement the, “Stop Addictive Feeds Exploitation (SAFE) for Kids Act” passed in 2024. The law focuses on platform design and parental consent.
VT: The Attorney’s General Office proposed rules for implementing the state’s Age Appropriate Design Code passed in 2025 and is now open for public comment until October 2nd.
This week, California’s Governor announced an AI Cyber Defense Program, including expanding cyber capabilities and designating an AI Cybersecurity Officer in each state agency.
The U.S. National Science Foundation announced $100 million towards NSF State and Regional Artificial Intelligence Infrastructure Hubs which will initially support up to 10 projects, with one award made per state or region.
